Permission to use user generated content

The University of Hertfordshire (the “University”, “we”, “us” and “our”) reaches out to social media users to seek their permission to feature our favourite ‘user generated content.’ ‘User generated content’ includes photos, text, graphics, audio, video, location information, comments and other materials from social media sites, for use by the University in connection with our staff and student communications, events programmes, alumni activities, fundraising programmes, corporate publications, recruitment collateral and emails, prospectuses and for the promotion of benefits and services (the “University Services”).

You are reading this because the University has requested your permission to use your user generated content in this way.

If you choose to allow us to use your user generated content (“User Content”) by replying with the hashtag #GoHerts, you agree to the terms set out in this Permission. You also acknowledge that the opportunity to feature in any of the above is offered with no remuneration and with no obligation on the University to use the User Content.

User Content Licence

You hereby grant the University, its related companies, agents, licensees, sublicensees, contractors, assigns, and third-party service providers (the “Licensed Parties”) a worldwide, non-exclusive, irrevocable, royalty-free, transferable and sublicensable licence to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in any way we determine in our sole discretion in connection with the University Services.

The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Content in any manner in their sole discretion, with no obligation to you whatsoever.

You also grant the Licensed Parties the right (but not the obligation) to use your username, real name, image, likeness, descriptions of you, location or other identifying information, including but not limited to your voice, in connection with any use of your User Content.

You represent to the University and the Licensed Parties that i) you own all User Content and/or have the unrestricted legal right to grant the above licence, ii) you are aged 18 or over, iii) the use of the User Content by the University and the Licensed Parties will not infringe any third party copyrights or other third party intellectual property rights or rights of privacy or publicity, iv) the User Content is not libellous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive or otherwise unlawful; and v) any identifiable individual in any image or photograph is aged 16 or above and has agreed to the use of their image.

You agree to indemnify the University and the Licensed Parties for any and all losses resulting from the invalidity or inaccuracy of the above representation.

This permission, its subject matter and formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
