Mental health law

Who should attend this course?

Students who have a first degree in a related discipline. Two years full time experience (or equivalent) within a relevant field of practice. Registration with the appropriate professional body Employment in, or access to an appropriate area of mental health practice whilst enrolled on the programme is also required.

Course content

The module examines and develops understanding of relevant aspects of mental health law applicable to contemporary healthcare practice. The module enables participants to examine and critically evaluate the legal and ethical implications of important aspects of mental health law. The specific issues which will be addressed are:

  • The definition of mental disorder
  • The role of statutory providers
  • Compulsory detention
  • Treatment for mental disorder without consent
  • Challenging detention
  • The impact of human rights law on mental health law
  • Mental Health Act 2007 – an overview of the important reforms
  • Mental Capacity Act 2005

Assessment

The module will be delivered in study day format over two full days and may be studied as attendance-only, or assessed. Where assessment is selected, further sessions will be scheduled for assessment direction and support. Credits can form part of a Masters Degree programme offered by the School of Postgraduate Medicine.
